This document describes the contractual terms and conditions (hereinafter “TERMS OF USE”) applicable to the access and use of the products made available by Maria Helena Andrade Godinho Garcia Rollo and José Carlos Varela Pinto Garcia Rollo, co-owners of the Colecção Imagens JCR brand (hereinafter 'Colecção Imagens JCR') through its website https://www.imagens.jcr.com.pt

By accepting these TERMS OF USE, the Member declares that he is older and has the legal capacity to contract in accordance with Portuguese civil law. People who do not have the legal capacity to hire and minors cannot purchase the services provided through the Web Site. Object / Who the products are for
The object of these TERMS OF USE are intended for individuals, companies, associations and schools that wish to purchase a Service or Product from the Colecção Imagens JCR.
These conditions are agreed between the Colecção Imagens JCR and the Member who wishes to place an order for a Service or Product, through the Colecção Imagens JCR website, https://www.imagens.jcr.com.pt , the parties agree that their Relationships will be governed exclusively by this contract, excluding any conditions previously available on the Web Site, or by other conditions that may be established between the parties for Photography Services.
The present conditions aim to define the sales modalities between the Colecção Imagens JCR and the Member, from ordering the Services and Products (physical and digital) to delivery, through the payment method.

Visitor and Member
The Web Site https://www.imagens.jcr.com.pt of the Colecção Imagens JCR is a Site with free access to any person, natural or collective, whom we designate as Visitor, with exclusive areas for Members.
We designate as Member all Visitors who register on the Colecção Imagens JCR Web Site.
To access the Services and Products that are promoted through the Web Site https://www.imagens.jcr.com.pt, each visitor is required to register as a Member. To complete this registration, an email will be sent to the e-mail address indicated by the Visitor, in which we must confirm the registration. Only after this confirmation will the Colecção Imagens JCR confirm the Visitor as a Member, which he / she will do by sending a 2nd email to confirm the registration.

The information or personal data entered in each of the fields on the Form must be accurate, precise, and true. The Member undertakes to keep the information contained in "My Account" up to date.
The Colecção Imagens JCR is not responsible for the accuracy of the information provided by the Member. The Member guarantees and responds, in any case, for the veracity, accuracy and authenticity of the personal data entered.
Each account is personal, unique, and non-transferable, and the possibility for a Member to have more than one active account is expressly prohibited. If the Colecção Imagens JCR detects accounts that contain similar data related to a single Member, the Colecção Imagens JCR reserves the right to cancel access by the Member to all or some of its accounts
The Member is responsible for all operations carried out in "My Account", whose access is restricted, as the "User" and "Password" are only available to the Member.

Designations
“Content” is all content available for promotional offers or online sales on the Colecção Imagens JCR website, including Images, Videos / multimedia and Music
"Video" refers to any moving image and multimedia productions (time lapse, films, videos, animations, etc.).
"Image (s)" refers to static photographs, vectors, drawings, graphics, and the like.
"Music" refers to any musical compositions, original recordings and any other recordings that contain sounds or a series of sounds, in all formats, known now and further developed.
“Visual Content” refers collectively to Images and Videos.

Orders are understood to be the purchase of any Service or Product for sale on-line. Online Store Products
The Member can place his order through the online device by selecting "Store / Cart" and then from the online catalog presented for each Category; To place your order, the Member must log in (input his user code and password) and fill in the necessary data for delivery of the product. The fact that the Member places his order is equivalent to full and complete acceptance of the prices and description of the products available for sale as well as the general conditions of sale, the TERMS OF USE and the TERMS OF LICENSES OF USE that will be the only ones applicable to the contract as well concluded. Any dispute on this last point will be resolved through a negotiable solution and with the guarantees mentioned below. The Colecção Imagens JCR reserves the right to refuse an order for reasons that will later be justified to the Member. User License Terms
Through the LICENSE TERMS OF USE, the Colecção Imagens JCR grants you a non-exclusive, non-transferable, global and perpetual right to use, modify (modifications subject to the Use Restrictions indicated in these TERMS OF USE) and reproduce visual content, as expressly permitted applicable license and subject to the limitations set out in these License Terms of Use.
License costs are already included in the sale price of our content.
Restrictions on Use of Visual Content
NOT ALLOWED:
Use the Visual Content in a manner other than that expressly determined by the license you have purchased for the Visual Content.
Portray any person presented in Visual Content (a “Model”) in a way that may be considered offensive, including, without limitation, representing a Model: a) in association with pornography, “adult videos”, adult entertainment venues, escort services, dating services or the like; b) in association with advertising or promotion of tobacco products; c) in a political context, such as the promotion, propaganda or endorsement of any party, candidate or elected politician, or in connection with any policy or political point of view; d) as a carrier or consumer of medicines for physical or mental illnesses; or e) participating in immoral or criminal activities.
Use any Visual Content in a pornographic, defamatory, or misleading context, or in a way that could be considered libellous, obscene or illegal.
Modify Visual Content acquired under Standard License (editorial use) so that it changes the context of what is portrayed.
Resell, redistribute, provide access to, share or transfer any Visual Content except as explicitly specified in this agreement. The previous provisions consider the prohibition, for example, of making the Content available in the format of a “gallery” of contents (or as part of one), in which third parties can carry out searches and selections from the same.
Use Visual Content in such a way as to infringe any trademark or intellectual property of third parties, or to cause legal action for misleading advertising or unfair competition.
Use any Visual Content (full or partial) as a trademark, service mark, logo or other indication of origin, or as part of one.
Falsely declare, either explicitly or reasonably implied, that Visual Content was created by you or someone other than the copyright owner (s) of that Visual Content.
Use any Visual Content in a multimedia production distributed by broadcast, cable TV, OTT video service (for example, Netflix, Hulu, Amazon), in cinemas or in related promotional materials.

Delivery
The delivery of orders will be made to the address indicated by the Member when placing the order. The delivery of orders can be made at home or at any other address indicated by the Member or agreed with the Colecção Imagens JCR at the ordering stage.
The costs and delivery times will be communicated to Members at the time of ordering. The Member when placing an order is accepting the costs and delivery times communicated at the time of order. The shipping costs accepted by the Member at the time of purchase correspond to a Packing and Delivery Service at a CTT post for sending by Registered Mail, or by shipping by a private freight company.
Home delivery cannot be made in PO boxes.
Any orders destined outside the EEC will be subject to customs fees that will be borne by the Member. We suggest that you inform yourself in advance about the costs associated with importing products.
The Colecção Imagens JCR is committed to delivering the ordered items as soon as possible.

Payments and Promotions

If you want to pay by bank transfer, simply send your wish and we will provide you with our bank identification.
When making a payment by bank transfer, send us an email with proof of the transfer order to check the correspondence between your order and the amounts credited to our account.
Payments for products from the On-Line store, to be made by bank transfer must be made within a maximum period of 5 days. If not, we will consider the order canceled.

Pricing
Prices must be understood in Euros, with taxes and fees included and excluding shipping costs.
The prices shown take into account the VAT applicable on the day of the order in Mainland Portugal. Any modification of the applicable VAT type will be reflected in the prices of the products.
Any cross-border costs, such as customs fees under the laws of your country or country of residence, will be the responsibility of the Member or Customer.

Modifications
With the exception of the "Banner Insertion" products in the advertising area, and some services from its On-Line store, the Colecção Imagens JCR has the flexibility for its Members to obtain personalized services according to their objectives.

Prohibitions
Members of the Colecção Imagens JCR Website may not:
- Be registered without having previously accepted the Terms and Use;
- Be registered with more than one account;
- Confirm a purchase order, when they are not sure that they are actually going to make the purchase, by how much this action may impair the smooth functioning of the Website, as well as impair the benefits of other Members of the Website.

Intellectual Property Rights
All elements of the Colecção Imagens JCR website that are visual or audible, including the underlying technology, are protected by copyright, trademarks, or patents. All these elements are the exclusive property of the Colecção Imagens JCR, or of commercial partners. The Member who has a Web Site on the Internet and who wishes to place, for his personal use, a link that he sends directly to the Web Site of the Colecção Imagens JCR, must mandatorily request authorization from the Colecção Imagens JCR. “Non-transferable” means that, except as expressly granted in these TERMS OF USE, you must not sell, rent, assign, sub-license, or make any other form of transfer to any person of Visual Content or the right to use it. You may, however, make a single transfer of Content to a third party, for the sole purpose of that third party printing and / or manufacturing your products incorporating the Content in accordance with the terms and conditions of this agreement. If you become aware that any Social Media Site is using Visual Content in a way that exceeds the User License you have purchased, you agree to remove all derivative works that incorporate the Visual Content from such Social Media Site, and immediately notify the Colecção Imagens JCR of that use of the Social Media Site. You agree to take all commercially acceptable measures to prevent third parties from duplicating any Content. If you know of any unauthorized duplication of any Content from the Colecção Imagens JCR, please notify us by e-mail This email address is being protected from spambots. Upon notification from the Colecção Imagens JCR or if you become aware that any Content is subject to an allegation or threat of an alleged violation of any other right, or any claim for which the Colecção Imagens JCR may be liable, or whether the Colecção Imagens JCR remove any Content due to perceived commercial risks, as determined by reasonable criteria from the Colecção Imagens JCR and notify you of such removal, you will remove the Content from your computer systems and storage devices (electronic and physical) and, if possible , will terminate any future use of the Content removed at its own expense. However, the Colecção Imagens JCR may be affiliated with Sites selling products online. Any Member or visitor who clicks on one of the ads associated with those affiliations will be subject to the Terms and Conditions of those Sites, including Cookies, Privacy and Intellectual Property Rights Policies.

Upgrades
Whenever necessary, operations will be carried out to verify the marketed products, so that they can be updated to the latest versions, or discontinued temporarily, or permanently. Signature and Proof
All Members must register in order to place orders for Services or Products in the Colecção Imagens JCR Registration data is strictly personal. In case of loss or forgetting your PASSWORD the Member can start the password recovery process in the same Authentication window (Login on the website).
The indication of the requested data for the payment to be made and the final validation of the order, on the Site or via email, will constitute proof of the order in accordance with the legal provisions and will allow for the demandability of the amounts that appear in the order form. This validation is valid as a signature and acceptance of all operations carried out on the Web Site.
Any Service or supply of ordered products, will only be carried out / sent after confirmation of good collection of the respective values.

Unauthorized use
If you violate any of the terms of this or any other contract with the Colecção Imagens JCR, the Colecção Imagens JCR will have the right to close your account without prior notice, in addition to the other rights of the Colecção Imagens JCR by law and / or equity. The Colecção Imagens JCR has no obligation to refund any costs paid by you if your account is closed as a result of a breach.
Except as expressly determined in this agreement, the Colecção Imagens JCR does not grant rights or offer guarantees regarding the use of personally identifiable information that may be visible in Visual Content, music or other audio in videos, trademarks, image sets, or designs or works of copyrighted art or architecture represented in any Visual Content. The Colecção Imagens JCR only has authorization contracts for the use of a model or property image when expressly indicated on the Colecção Imagens JCR website.
In no event shall the full responsibility of the Colecção Imagens JCR, before you or any third party making a claim on your behalf, arising from or related to your use or the inability to use the Colecção Imagens JCR website and / or the Content contained therein (contractually) , for illicit act or otherwise) will exceed the monetary value actually received by the Colecção Imagens JCR from you under the applicable Content license.
Neither the Colecção Imagens JCR nor any of its officials and employees or suppliers will be liable to you or any other person or entity for any general, punitive, special, indirect, consequential or incidental damages or for loss of profits or any other damages, expenses or losses arising from your use of the Visual Content, the violation of the Colecção Imagens JCR of this contract, or, except when explicitly provided in this instrument, even if the Colecção Imagens JCR has been informed about the possibility of such damages, expenses or losses.

Warranty, Support and Refund Policy

Provision of Services (Termination of a Contract)
The Member has 14 days, after concluding the contract / Adjudication of the Service, to terminate the contract without any penalty or obligation to indicate the reason for the termination.
If, at the request of the client, the Colecção Imagens JCR has started to provide the service ordered before the end of the withdrawal period (for example, development of training content) and the client has decided in the meantime to terminate the contract, the latter must pay for the service provided up to that point.

Online Store Products
Some of the images used to illustrate physical products are indicative and may not correspond exactly to the product in question. The Colecção Imagens JCR makes every reasonable effort to ensure the accuracy and conformity of the Site, reserving the right to freely change the contents of the Site, at all times and without prior notice. The Colecção Imagens JCR accepts the request to exchange or return your items within a maximum period of 14 days, provided that they are in their original packaging without any damage to both the Product and the packaging and in accordance with the conditions of then expressed. Any return, exchange or credit will only be made after good reception of the returned product. The transport expenses arising from the exchange or return are the responsibility of the Member. The Colecção Imagens JCR does not accept returns sent with postage paid or with a refund.
In the event that the return is the cause of a logistical error in the Colecção Imagens JCR, the Colecção Imagens JCR after contacting the Member, will assume the costs of the return, as well as the shipping costs of the correct product.
The request for exchange or return of products must be made within 14 days after receipt of the order, at the address indicated by the Member. The period that allows the return or exchange of the product starts on the day the delivery is attempted by the distribution company, so the Member should as soon as possible pick up the order at the delivery points, if it is absent the indicated address. Returns will only be accepted when within the stipulated period and exchanges are subject to availability of stock. An unsatisfied exchange order automatically generates a return and a consequent credit. Returns generate a credit for the value of returned products. This credit is given in the format of Colecção Imagens JCR credits, which can be used in any campaign of the Colecção Imagens JCR Collection and have no expiration date.
Due to the nature of our Products, returns and exchanges will not be accepted after the 14-day reflection period.
The return of orders, due to lack of withdrawal by the Member, does not generate any type of credit or refund for the Member. The Member will be contacted by the Colecção Imagens JCR in order to arrange a second delivery, and the Member must make the prior payment of new shipping costs.

The Colecção Imagens JCR cannot guarantee that advertising products, when available, offer complete stability, performance and endless global capabilities. For all stages of access to the Web Site, from the order process to delivery or to the subsequent Services, the Colecção Imagens JCR only has an obligation of means. Advertising Products
The contents are the exclusive responsibility of the Member / Client in accordance with the General Advertising Conditions referred to in our Advertising Catalog. Catalog available in our catalog area.

Photographic Services / Private Groups
The original files and the treated images, following photo sessions are stored in our digital archives for a minimum period of 1 year. After this period, Colecção Imagens JCR reserves the right to delete these files, in whole or in part.
During this period, the files are archived in a double way (originals and backups).
However, the loss of some data may exist, for reasons beyond our control.
The Member may request in advance, at the end of that period, a copy of this file under conditions to be agreed with the Colecção Imagens JCR.

Extra Services
Any Extra Services that may be made available by the Colecção Imagens JCR to Members must be carried out in accordance with Specific Conditions to be announced or to be agreed with Members.

Proof
The computerized records, kept in the computer systems of the Colecção Imagens JCR and its partners in reasonable security conditions are considered as proof of the communications, orders and payments produced between the parties.

Total Agreement
The present conditions of TERMS OF USE constitute the total agreement between the parties in reference. In the event that one of the clauses of this contract is declared null and void, due to a legislative, normative or sentence amendment, it will not lose its validity, and compliance with the present TERMS AND CONDITIONS of USE is mandatory. The Colecção Imagens JCR reserves the right to change these TERMS OF USE at any time.

Transaction Conservation and Archiving
The filing of orders and receipts / invoices will be made on a reliable and durable medium to correspond to a faithful and long-lasting copy.

Applicable Law and Jurisdiction
Portuguese law applies to the conditions of this contract. The attribution of jurisdiction in the event of a dispute, and the lack of amicable agreement between the parties will be submitted to the competent courts of Portugal despite the plurality of defendants and / or whatever the type of procedures.
